These Terms of Service (“Terms”) govern your access to the Zero Gap Consult website and any proposals, statements of work, or campaigns we deliver as Zero Gap Consult (“ Zero Gap Consult”, “we”, “us”). By using our site or engaging our services, you agree to these Terms.

1. Who we are

2. Website use

You may browse our website for lawful purposes only. You agree not to misuse the site, attempt unauthorised access, interfere with security, scrape content at scale without permission, or use the site in any way that could damage our reputation or systems.

3. Services and contracts

Marketing services are provided under separate agreements (for example a proposal, order form, or statement of work). If there is a conflict between these Terms and a signed service agreement, the service agreement prevails for that engagement. Until a written scope is agreed and any deposit or approval required is received, no obligation to deliver work arises.

4. Client responsibilities

You will provide accurate information, timely approvals, lawful assets (including creative, data, and landing pages), and compliance with applicable advertising, privacy, and consumer laws. You represent that you have the rights to materials you supply and that their use will not infringe third-party rights.

5. Third-party platforms

Delivery may rely on advertising networks, publishers, email tools, analytics products, and other third parties. Their terms, policies, and technical limits apply in addition to ours. We do not control platform outages, policy changes, or auction dynamics.

6. Intellectual property

Unless otherwise agreed in writing, Zero Gap Consult retains ownership of our pre-existing methods, templates, and tools. Deliverables created specifically for you transfer as set out in your service agreement. You grant us a licence to use your marks and materials as needed to perform the services.

7. Confidentiality

Each party will protect the other’s non-public business information and use it only for the purpose of the engagement, subject to standard exceptions (for example legal requirement or information already public).

8. Disclaimers

Marketing results depend on markets, product, budget, and external factors. Except where prohibited by law, the website and any general information on it are provided “as is” without warranties of any kind. Nothing on this site guarantees specific performance metrics.

9. Limitation of liability

To the fullest extent permitted by law, Zero Gap Consult is not liable for indirect, incidental, special, consequential, or punitive damages, or for loss of profits, revenue, goodwill, or data arising from your use of the site or services. Our aggregate liability for claims relating to the site (outside a signed service agreement) is limited to one hundred Singapore dollars (SGD 100).

10. Indemnity

You will defend and indemnify Zero Gap Consult against claims arising from your content, your products, your instructions, or your breach of these Terms or applicable law, except to the extent caused by our wilful misconduct.

11. Suspension and termination

We may suspend or terminate access to the website where we reasonably believe there is risk, abuse, or legal exposure. Service engagements end according to their contracts and any notice periods stated there.

12. Governing law

These Terms are governed by the laws of Singapore, without regard to conflict-of-law rules. Courts in Singapore have exclusive jurisdiction, subject to any mandatory rights you may have as a consumer.

13. Changes

We may update these Terms by posting a new “Last updated” date on this page. Material changes to how we run the public website will be reflected here. Continued use of the site after changes means you accept the revised Terms.
